Emotional loss is the loss sustained because of the grief following the death or severe injuries of a loved one. It is a specific type of non-economic damages for which loved ones of victims could qualify under circumstances. The right to compensation of emotional loss was introduced on 1 January 2019 and applies only to loss arisen on or after that date. Not every loved one can claim emotional loss. The question whether and if so, what amount is awarded, depends on a variety of circumstances like the relationship between the loved one and the victim and the severity of the injuries.
